Terms & Conditions

These Terms and Conditions are applicable every time you access our website and/or order goods from our website. Before proceeding with an order you will be required to show that you have read and understood the following terms and conditions. We recommend that you print a copy for your future reference.

Payment

We accept Credit & Debit Card payments via Sage Pay and PayPal.

The cards that we accept are, (Master Card / Visa / Visa Delta / Visa Electron / Visa Purchasing and Maestro). Goods will not be delivered until the customer's funds have been paid to Stationary Engine Parts Ltd T/A Paragon Paints and have cleared in full.
 
Where a payment is made and a customer cancels the order or changes their mind please note that merchant service fees are non refundable and will be deducted from the total refunded.

Order Notes.

Please note that all transactions will be carried out in Sterling. Once you have placed your order, confirmation will be sent to you via e-mail complete with your transaction and order reference numbers. At this stage an order cannot be added too or amended. Stationary Engine Parts Ltd T/A Paragon Paints monitor prices on a daily basis. We will not be held responsible for pricing errors due to software mal-functions, or human error. This website operates on an 'invitation to trade' basis and not as an 'offer for sale' as a result, Stationary Engine Parts Ltd T/A Paragon Paints reserves the right to decline orders for bulk or high value purchases.

Delivery.

We aim for your order to be dispatched to you within 7 working days after receipt of your confirmed order but time scales may vary depending upon the delivery location. To keep shipping costs to a minimum lower value orders are often sent by standard non traceable Royal Mail services unless we are requested to do otherwise. You are responsible for ensuring the accuracy of your order and the details provided in your order form. We reserve the right to impose a service charge to cover the cost of any action we may take to ensure the safe delivery of your order when supplied customer details are incorrect. We will be entitled to charge your account with any costs incurred by us in respect of any missed, incorrect or insufficient address details.

Credit Card Security.
 
At the check out stage, you will be passed on to our Secure Order Processing page via Sage Pay, your details will be encrypted by 128-bit industry-standard Secure Sockets Layer (SSL) technology to provide encryption of personal information such as your name, address and credit card details.

Shortages & Damage In Transit.
 
Any shortages damages or dissatisfaction of delivered items must be notified to Stationary Engine Parts Ltd T/A Paragon Paints within two working days of delivery. Stationary Engine Parts Ltd T/A Paragon Paints will not be held liable for shortages, damages or issues related to cosmetic finish notified after this period.
 
Stationary Engine Parts Ltd T/A Paragon Paints strongly advises that all goods delivered are thoroughly inspected upon delivery prior to signing any delivery manifest for the goods as "received in satisfactory condition". Stationary Engine Parts Ltd T/A Paragon Paints will not be held liable for goods damaged during delivery if the delivery agent’s manifest is not marked accordingly.
 
Returns, Cancellations & Guarantee.
 
We want every item you purchase from us to match your expectations. We simply ask that you follow these guidelines to help us process your return as quickly and efficiently as possible. The customer may only return products to Stationary Engine Parts Ltd T/A Paragon Paints, and receive a credit or refund, on the following conditions:

The Customer must contact our customer services team on 01904 607584 prior to the return of any products and obtain the prior consent and a returns number (to be quoted on all returned paperwork) Returns must be made within 14 days of the date of dispatch, If you have not requested a return within 14 days of receiving an order, we will have assumed that you are intending to keep it and we will not authorise a return. Products must be returned in their original condition and packaging and in a condition which will enable them to be immediately fit for re-sale. Products must be returned adequately packed and dispatched prepaid by a tracked service, clearly labelled to: CUSTOMER RETURNS, Stationary Engine Parts Ltd T/A Paragon Paints, Wheldrake Lane, Elvington, York, North Yorkshire, YO41 4AZ.

The Customer must quote the invoice details or the reference number on the original dispatch note; otherwise any credit given for the returned products will be based upon the lowest sales price. All carriage charges are non refundable.

Where the customer returns products not in accordance with the above conditions (for example, after 14-days from the date of dispatch or in an unfit state) Stationary Engine Parts Ltd T/A Paragon Paints may refuse delivery and return the products at the Customer's expense or may apply a handling and repacking charge of 10% (subject to the minimum charge of £10.00) This charge will be subject to our inspection of the returned goods. Please allow up to 14 days to process a refund from the date of the return of goods.

This returns policy excludes mixed / specially manufactured products including but not limited to all paint(s). Please be advised that Stationary Engine Parts Ltd T/A Paragon Paints do not stock ready mixed paint products, all paint sold is mixed specifically to meet your order requirments. Stationary Engine Parts Ltd T/A Paragon Paints accepts no responsibility for any form of colour or finish deviation, batch discrepancies or other inconsistencies in supply after the product has been used. Stationary Engine Parts Ltd T/A Paragon Paints accepts no responsibility for any loss of or damage to products in transit from the customer to Stationary Engine Parts Ltd T/A Paragon Paints.

All new products manufactured or sold by Stationary Engine Parts Ltd T/A Paragon Paints are guaranteed free from defect caused by faulty materials or workmanship for a period of 6 months from the date of dispatch, either by Stationary Engine Parts Ltd T/A Paragon Paints or the respective manufacturer.

All custom made, cut or prepared items and special order items including paint supplied by Stationary Engine Parts Ltd T/A Paragon Paints are personalised for you (Manufactured to your specification) and supplied with a limited guarantee. As we are manufacturing or mixing goods to your specification we cannot offer any form of refund on these items once manufactured. We do not accept ANY returns unless pre-arranged by us. All deposits paid on cancelled orders are non refundable.
 
Finally, please remember that notifying us of your intention to apply for a return, saving the delivery paperwork and keeping the order in its original packaging will help both you and us to process an eligable return quickly.
 
Right To Cancel Under The Consumer Regulations
 
We have explained below how you can exercise your right under the Consumer Regulations to cancel your contract with us. Please note that in many cases our own returns policy may be applicable or may be more suitable for your requirements.
 
You have a right to cancel a purchase contract within 14 days without giving any reason. The cancellation period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and dictated by you acquires, physical possession of the goods. This policy should be read in conjunction with our Terms and Conditions of Sale in the event of a conflict between this policy and our terms and conditions, our terms and conditions will apply.
 
To exercise the right to cancel, you must inform us of your decision to cancel this contract by a clear statement. To meet the cancellation deadline it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired.
 
If you cancel this contract, we will reimburse to you all payments received from you, including the costs of delivery (except for supplementary costs arising if you choose a type of delivery other than the least expensive type of standard delivery offered by us).
 
We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by you or to cover administration costs. We will make the reimbursement without undue delay and not later than 14 days after the day we receive back from you any goods supplied, or if there were no goods supplied, 14 days after the day on which we are informed about your decision to cancel this contract.
 
We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise. You shall send back the goods without undue delay and in any event not later than 14 days from the day on which you communicate your cancellation from this contract to us. The deadline is met if you send back the goods before the period of 14 days expires. You will have to bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
 
Where You Do Not Have A Right To Cancel
 
Where goods have been personalised, mixed or specially manufactured to your requirements, including but not limited to all paint(s). Then you will not be entitled to cancel the contract under the Consumer Regulations.

Technical Advice & Product Suitability.
 
Technical information is given in good faith. It is considered the responsibility of the customer to ascertain suitability of a product for any specific purpose before use. The company is unable to control the method of application, the skill of the applicator, the site conditions or the storage conditions of the product once it has left the care of Stationary Engine Parts Ltd T/A Paragon Paints. Guarantee shall not be affected by and no obligation or liability shall result from providing technical advice or service in connection with the customer's order or the goods supplied.

Remedies & Damages.
 
Stationary Engine Parts Ltd T/A Paragon Paints shall not incur any liability under the above guarantee unless:

(A) Stationary Engine Parts Ltd T/A Paragon Paints is promptly notified in writing upon discovery by the customer that such goods do not conform to the guarantee; and
(B) the alleged defective goods are returned to Stationary Engine Parts Ltd T/A Paragon Paints, carriage prepaid; and
(C) examination by Stationary Engine Parts Ltd T/A Paragon Paints of the goods shall confirm that the alleged defect exists and has not been caused by misuse, neglect, methods of storage, faulty installation, handling, testing or repair, or by alteration or accident.

Stationary Engine Parts Ltd T/A Paragon Paints liability shall be limited to replacing, repairing or issuing credits at its option for any goods returned within the above mentioned period. Any replacement goods issued will be supplied as soon as is practically possible but no time frame is implied for non stock or special order items. Stationary Engine Parts Ltd T/A Paragon Paints shall not be liable for incidental or consequential damages for any breach hereof, including, but not limited to costs of removal and re-installation of goods, loss of goodwill, loss of profits or loss of use.
 
Unlawful or Prohibited Use.

You shall not use this site for any purpose that is unlawful or by any means prohibited under this terms and conditions.
